When Do Children Need Guardians?

  • Children whose parents have died need a guardian.
  • Children with drug-addicted, abusive or otherwise incapable parents need guardians; often it is a grandparent or other relative.
  • Children who have been awarded a substantial amount of money must legally have a guardianship of his or her estate, with the probate court having control over the use of funds.

When Do Adults Need Guardians?

When you are dealing with older populations, stroke or Alzheimer's may render a person unable to make decisions. Someone else must take charge of that person's health care and financial decisions. Our firm can also obtain emergency temporary guardianship in situations where the incapacitation was sudden and unexpected.

Contested Guardianships

If someone who has remarried is rendered incapacitated due to stroke or Alzheimer's and he or she has no power of attorney or health care directives in place, the person's spouse and children may disagree on who should become guardian. If an understanding cannot be reached, our firm can offer representation in probate court.
