Probate
In the probate process, the deceased person's estate must be "opened" by court decree. The deceased person's assets, including property and IRAs, are gathered together and valued. Debts are also totaled, with assets used to pay debt. After the debt is paid, all remaining assets are distributed according to the will's direction by an executor, which is usually a loved one.
It is a complicated process and an attentive, knowledgeable and thorough attorney can make a significant difference in how you and other family members move through such a difficult time in your life.
